Frequently Asked Questions

The Apostille or Hague Apostille is a unique certification, implemented in Chile since August 2016, which allows public and private documents to have an official certification, valid in the other member countries of the Hague Apostille Convention.

Our office can take care of apostille documents, both in Chile and abroad.

The holders of Transitory Stay may NOT perform remunerated activities.

Exceptionally, those who need to carry out specific and sporadic activities, and who as a direct consequence of these activities receive remuneration or economic benefits in Chile or abroad, may apply to SERMIG for authorization to carry out such work.

Foreigners who intend to settle in Chile for a limited period of time must apply for temporary residence by fulfilling the requirements of the migratory subcategory to which they wish to apply, the duration of this residence permit will be up to 2 years.

The following cases may apply for temporary residence within the country:

– When they accredit to have family ties with Chileans or with definitive residents.

– Those who already have the status of holder of a Temporary Residence permit and wish to change their migratory subcategory, extend it, or change the quality of the residence permit in the case of dependents.

– Subcategories of Temporary Residence based on humanitarian reasons (paragraph eight of Decree N°177/2022).

-Applications that by express mention of Decree N°177/2022 must be made by public entities.

– The holders of Temporary Stay who entered the country before 12.02.2022, may also apply for a residence permit within the national territory.

The new immigration law indicates that the definitive residency will be tacitly revoked if the foreigner remains outside Chile for more than 2 years continuously, unless the interested party is unable to enter the country and requests an extension at the nearest Chilean consulate at least 60 days prior to the expiration date.

The deadline to apply for the Permanent Residence is no more than 90 days before the expiration of the current residence permit.

It is also possible to apply for and obtain the definitive residence permit notwithstanding the validity of the temporary residence permit held, as long as the term that enables it, defined for the respective subcategory, has been completed (Art. 62 of the Migration and Alien Regulation).

If you attach erroneous or incorrect information, you will be notified by e-mail of the request for more information, and you will have a period of 60 calendar days, counted from that notification, to send the requested documents through the SERMIG’s Digital Procedures Portal. If you do not do so within the indicated term, your application may be rejected according to Art. 88 of Law No. 21,325 on Migration and Aliens.

In order to apply for Permanent Residency, temporary residents who are holders of subcategories of applications filed after May 14, 2022, must have resided in the country in that capacity for at least 24 months.

Those who have reached 18 years of age, are holders of Permanent Residence in force, and have five years or more of residence in Chile (counting from the date of obtaining the stamp of the Temporary Residence that gave rise to the Permanent Residence that remains in force).
